SEXUAL VIOLENCE POLICY

  • Academy of Learning Career College is committed to providing its students with an educational environment free from sexual violence and treating its students who report incidents of sexual violence with dignity and respect.
  • Academy of Learning Career College has adopted this Sexual Violence Policy, which defines sexual violence and outlines its training, reporting, investigative and disciplinary responses to complaints of sexual violence made by its students that have occurred on its campus, or at one of its events and involve its students.
  • The person accused of engaging in sexual violence will be referred to as the “Respondent” and the person making the allegation as the “Complainant”.

DEFINITION OF SEXUAL VIOLENCE

Sexual violence means any sexual act or act targeting a person’s sexuality, gender identity or gender expression, whether the act is physical or psychological in nature, that is committed, threatened or attempted against a person without the person’s consent, and includes sexual assault, sexual harassment, stalking, indecent exposure, voyeurism and sexual exploitation.

TRAINING, REPORTING AND RESPONDING TO SEXUAL VIOLENCE

  • Academy of Learning Career College shall include a copy of the Sexual Violence Policy in every contract made between it and its students, and provide a copy of the Sexual Violence Policy to career college management (corporate directors, controlling shareholders, owners, partners, other persons who manage or direct the career college’s affairs, and their agents), instructors, staff, other employees and contractors and train them about the policy and its processes of reporting, investigating and responding to complaints of sexual violence involving its students. *Any company participating in offering student internships on their premises must provide an undertaking in writing that it is in compliance with all applicable legislation, including the Ontario Human Rights Code and the Occupational Health and Safety Act and will provide students access to those policies should they encounter issues relating to sexual violence in the workplace.
  • The Sexual Violence Policy shall be published on its website (or where the Career College does not have a website in a conspicuous location on each of its campuses).
  • Career college management, instructors, staff, other employees and contractors of Academy of Learning Career College will report incidents of or complaints of sexual violence to the Director upon becoming aware of them.
  • Students who have been affected by sexual violence or who need information about support services should contact the Director, Sunita Vyas at email ID sunita@aolmississiauga.com and our Campus Director Meenakshi Vyas at email ID min@aolcbrampton.com.
  • Subject to Section 4 below, to the extent it is possible, Academy of Learning Career College will attempt to keep all personal information of persons involved in the investigation confidential except in those circumstances where it believes an individual is at imminent risk of self-harm, or of harming another, or there are reasonable grounds to believe that others on its campus or the broader community are at risk. This will be done by:
    1. ensuring that all complaints/reports and information gathered as a result of the complaint/reports will be only available to those who need to know for purposes of investigation, implementing safety measures and other circumstances that arise from any given case.
    2. ensuring that the documentation is kept in a separate file from that of the Complainant/student.
  • Academy of Learning Career College recognizes the right of the Complainant not to report an incident of or make a complaint about sexual violence or not request an investigation and not to participate in any investigation that may occur.
  • Notwithstanding (f), in certain circumstances, Academy of Learning Career College may be required by law or its internal policies to initiate an internal investigation and/or inform police without the complainant’s consent if it believes the safety of members of its campus or the broader community is at risk.
  • In all cases, including (f) above, Academy of Learning Career College will appropriately accommodate the needs of its students who are affected by sexual violence. Students seeking accommodation should contact the Director, Sunita Vyas at email ID sunita@aolmississiauga.com.

In this regard, Academy of Learning Career College will assist students who have experienced sexual violence in obtaining counselling and medical care, and provide them with information about sexual violence supports and services available in the community listed in the Appendix A see below. Students are not required to file a formal complaint in order to access supports and services.

INVESTIGATING REPORTS OF SEXUAL VIOLENCE

  • Under this Sexual Violence Policy, any student of Academy of Learning Career College may file a report of an incident or a complaint to the Director in writing. The other officials, offices or departments that will be involved in the investigation are the Operations Department of the Franchisor Support Centre of the Academy of Learning Career College.
  • Upon receipt of a report of an incident or a complaint of alleged sexual violence being made, the Director will respond promptly and:
    1. determine whether an investigation should proceed and if the Complainant wishes to participate in an investigation.
    2. determine who should conduct the investigation having regard to the seriousness of the allegation and the parties involved.
    3. determine whether the incident should be referred immediately to the police.
  • In such cases or where civil proceedings are commenced in respect of allegations of sexual violence, Academy of Learning Career College may conduct its own independent investigation and make its own determination in accordance with its own policies and procedures.
  • Determine what interim measures ought to be put in place pending the investigation process such as removal of the Respondent or seeking alternate methods of providing necessary course.
  • Once an investigation is initiated, the following will occur:
    1. the Complainant and the Respondent will be advised that they may ask another person to be present throughout the investigation;
    2. interviewing the Complainant to ensure a complete understanding of the allegation and gathering additional information that may not have been included in the written complaint such as the date and time of the incident, the persons involved, the names of any person who witnessed the incident and a complete description of what occurred;
    3. informing and interviewing the Respondent of the complaint, providing details of the allegations and giving the Respondent an opportunity to respond to those allegations and to provide any witnesses the Respondent feels are essential to the investigation;
    4. interviewing any person involved or who has, or may have, knowledge of the incident and any identified witnesses;
    5. providing reasonable updates to the Complainant and the Respondent about the status of the investigation;
    6. following the investigation, the Director will:
      a) review all of the evidence collected during the investigation;
      b) determine whether sexual violence occurred; and if so
      c) determine what disciplinary action, if any, should be taken as set out in Section 5.

DISCIPLINARY MEASURES

If it is determined by Academy of Learning Career College that the Respondent did engage in sexual violence, immediate disciplinary or corrective action will be taken. This may include:

  • disciplinary action up to and including termination of employment of instructors or staff; or
  • expulsion of a student; and /or
  • the placement of certain restrictions on the Respondent’s ability to access certain premises or facilities; and/or
  • any other actions that may be appropriate.

APPEAL

  • Should the Complainant or the Respondent not agree with the decision resulting from the investigation, he or she may appeal the decision to the Operations Department of the Franchisor Support Centre of Academy of Learning Career College at the following address:

    within 10 business days by submitting a letter addressed to the Operations Manager of the Franchisor Support Centre of the Academy of Learning Career College advising of the person’s intent to appeal the decision; or immediately contact one of the following organizations in the Appendix A see below.
  • Should the Complainant or the Respondent not agree with the decision resulting from the investigation of the Operations Department of the Franchisor Support Centre of the Academy of Learning Career College, he or she may appeal the decision to the Ministry of Colleges and Universities.

STUDENT COMPLAINT PROCEDURE

Every career college must have a student complaint procedure to resolve complaints raised by a student. Under the Ontario Career Colleges Act, 2005 and its regulations, the Superintendent of Career Colleges can consider a student’s complaint only after:

  • the student has followed the college’s student complaint procedure.
  • has complained directly to the college.
  • is not satisfied with the outcome.

If you request the Superintendent of Career Colleges to review your concern or complaint submit it using the ministry’s Program Approval and Registration Information System (PARIS.) At your first visit, you will be asked to create a student account.

Your complaint or concern can be tracked easily and addressed directly through your account. You may also request a review of you complaint by email:

Once you submit your complaint and any supporting documents, the superintendent or a delegate will review the documents and advise you on next steps.

MAKING FALSE STATEMENTS

  • It is a violation of this Sexual Violence Policy for anyone to knowingly make a false complaint of sexual violence or to provide false information about a complaint.
  • Individuals who violate this Sexual Violence Policy are subject to disciplinary and / or corrective action up to and including termination of employment of instructors or staff or expulsion of a student.

 REPRISAL

  • It is a violation of this Sexual Violence Policy to retaliate or threaten to retaliate against a complainant who has brought forward a complaint of sexual violence, provided information related to a complaint, or otherwise been involved in the complaint investigation.
  • The student will not be asked inappropriate questions, for example related to drugs and/or alcohol.
  • Individuals who violate the Sexual Violence Policy are subject to disciplinary and/or corrective action, up to and including termination of employment of instructors or staff or expulsion of a student.
  • If students, in good faith, report an incident of, or make a complaint about, sexual violence, they will not be subject to discipline or sanctions for violations of the career college’s policies relating to drug or alcohol use at the time the alleged sexual violence occurred.
  • During the institution’s investigative process, students who disclose their experience of sexual violence through reporting an incident of, making a complaint about, or accessing supports and services for sexual violence, will not be asked irrelevant questions during the investigation process by the career college’s staff or investigators, including irrelevant questions relating to the student’s sexual expression or past sexual history. Examples of such irrelevant questions would include those relating to past sexual history or sexual expression.

REVIEW

  • Academy of Learning Career College shall ensure that student input is considered in the development of its Sexual Violence Policy and every time it is reviewed or
  • Academy of Learning Career College shall review its Sexual Violence Policy 3 years after it is first implemented and amend it where appropriate. This date is July 15th, 2024.

 COLLECTION OF STUDENT DATA

  • Academy of Learning Career College shall collect and be prepared to provide upon request by the Superintendent of Career Colleges such data and information as required according to Subsections 32. 3 (8), (9) and (10) of Schedule 5 of the Ontario Career Colleges Act, 2005.

The Victim Witness Assistance Program provides information, assistance and support to victims and witnesses of crime to increase their understanding of, and participation in, the criminal court process. The Sexual Assault and Domestic Violence provides services to anyone 12 years and older who have been sexually assaulted within the last 168 hours (7days). Admission through the Mississauga Hospital Emergency department, for individuals 12 years of age and older who require care, assessment/ documentation as a result of sexual assault/abuse. A referral to the sexual assault/Domestic services counselling is offered.

The personal support worker program provides an opportunity for students to develop basic nursing and social service skills necessary for long term employment in homes, facilities, congregate housing settings, and various programs in social institutions.  The pandemic has exhausted the province’s healthcare resources, the need for personal support workers on the front line today is paramount.

Personal support workers are an urgent need today. Ontario government will provide $86 million in grants and tuition to train 8,000 Personal support workers (PSW). Upon enrollment, students can get up to $13, 235 in grants, tuition fees, and internships. Update on the Canada Emergency Response Benefit (CERB)

“Our goal is to transition everyone on the CERB to Employment Insurance. In the coming weeks, we will create a transitional, parallel benefit that is similar to Employment Insurance.  This benefit will include access to training, and allow you to work more hours and earn more money. There will also be a sickness and caregivers benefit if you’re not covered at work if you get COVID-19, or if your kids or parents get it and you have to take care of them.  We’ll have more details to share in the coming weeks, but here’s the bottom line: we intend to cover every Canadian who is looking for work with a better, 21st century EI system. Apply for Canada Student Service Grant (CSSG)

Are you a post-secondary student or recent graduate? Do you want to help with COVID-19 response and give back to your community this summer? Do you want to build your resume and earn a grant this Fall?

What is CSSG?

The Government of Canada has recently created the Canada Student Service Grant (CSSG), a program that will provide thousands of qualified post-secondary students with learning and volunteer opportunities to address relevant COVID-19 challenges at Canadian not-for-profits during summer 2020. Students participating will be eligible to apply for a grant, which will provide up to $5,000 to be used towards post-secondary education costs. The grant is based on the number of validated volunteer hours completed between June 25, 2020 and October 31st, 2020. Student volunteers receiving the Canada Emergency Student Benefit (CESB) ($1,250 monthly) are also eligible to apply for a CSSG.

The new Canada Student Service Grant (CSSG) aims to encourage young people to take part in service activities that will help them support their communities’ COVID-19 response and gain invaluable experience.  

Administered by WE Charity, the CSSG is a one-time payment available at five levels, ranging from $1,000 to $5,000. The amount will vary based on the number of hours each volunteer completes, with $1,000 provided for each 100 hours completed, up to a maximum of $5,000 for 500 hours.

Eligibility

To be eligible to participate in a CSSG opportunity, a person must:

  • be enrolled and attending a part-time or full-time post-secondary education (PSE) during Spring/Summer 2020 and/or Fall 2020 at an accredited institution; or
  • have graduated from PSE no earlier than December 2019; and
  • be a Canadian Citizen, permanent resident, First Nations, Métis or Inuit, or have Refugee status; and
  • confirm they are able to participate in the CSSG if they are under 18 years of age by allowing us to contact their parent or guardian via email

To be eligible to receive the CSSG grant at the completion of the volunteer opportunity, a person must:

  • be a post-secondary student or recent graduate, 30 years of age or younger by December 31st, 2020, who meets the eligibility criteria including the required number of volunteer service hours
  • not be an international student or a person who has or is currently receiving the CERB ($2,000 monthly)

Study Alone

Second Career: Get Skills-training and Financial Support When You Qualify

What Second Career gives you

You can get new skills – those needed for jobs in demand now – and financial support when you qualify for Second Career.

Apply for up to $28,000 for costs including:

  • tuition
  • books
  • manuals, workbooks or other instructional costs
  • transportation
  • basic living allowance (maximum $410 per week)
  • child care

How you qualify for Second Career

As a start, you qualify for Second Career when:

  • you have been laid off and have not been working
  • you have been laid off and are working a temporary job just to cover costs

If you’re receiving Employment Insurance (EI), or have in the past, you can still apply.

When preparing your application, you also have to show:

  • how long you have been unemployed, or working your temporary job, and looking for work
  • places you have applied and positions you have applied for (e.g. cover letters, CV and responses from potential employers)
  • what level of education you reached
  • where you worked before, for how long and what skills you needed for that work
  • what skills you want to get and where you can get trained in them
  • information showing the skills and job you want to train for are in demand

What you pay into Second Career

When you apply to Second Career, you have to show the costs to be covered during training.

You may have to pay part of these costs yourself. The amount you’ll have to pay is based on several things, starting with your gross (before tax) household income.

Financial information

You must provide information about:

  • your income
  • your household income (e.g. spouse)
  • current expenses

School information

You must research at least three training institutions to make sure they offer the training you need. Make sure to include:

  • at least one college of applied arts and technology
  • at least one private career college

Job market information

You must show that the skills you want to get – and the work you want to do – are needed by employers. This can be shown through:

  • job postings
  • news of future job opportunities (e.g. office expansion, new company)

Now that we are in the middle of lock down and have plenty of time on our hands, this is the perfect time to turn our focus onto something which most of us are guilty of neglecting: us. Revisit an old skill

All of us have a kill that we have now stopped putting to use due to different reasons.
